Provided Sonia Ruiz
acknowledges owing the landlord $35,482 in rent arrears and vacates
premises by April 1, 2024, the landlord agrees to sever the due arrears from the
eviction petition.
Ruiz paid only partial rent monthly for four years, and evaded eviction for an
eighteen-month period, while harassing the rental
building employees and other tenants.
The order stipulated:
"5. Respondent [Sonia Ruiz] acknowledges owing $35,482.21 in arrears through the March 31, 2024. In consideration of above Petitioner [Landlord] agrees to sever said amount from this proceeding without prejudice to pursuing same in a subsequent plenary action. Respondent reserves all rights, claims and defenses to any plenary action.
6. The severance is solely conditional upon respondent vacating on or before April 1, 2024."
